These terms apply when you use the web studio at omnibanana.com (“the web studio”) and buy credits there. In these terms, “we” and “us” mean Omni Banana. By using the web studio you agree to them. The Omni Banana iOS app has its own terms.
1. Your account
You sign in with Apple or Google. Your web studio account, its credits and its history are separate from the iOS app.
You must be at least 13 years old to use the web studio. If you are under 18, you need a parent’s or guardian’s permission to buy.
You are responsible for what happens in your account. Tell us if you think someone else has used it.
2. Credits
Generating an image uses credits. The number depends on the model and options, and the studio shows it before you generate.
You get credits from a subscription or a one-time credit pack. Credits never expire while your account is open.
Credits have no cash value. They can’t be sold, transferred to another account or exchanged for money.
3. Subscriptions
The weekly and monthly plans are charged when you subscribe and then renew automatically at the start of each period, at the price shown when you subscribed, until you cancel.
Each paid period adds that plan’s credits to your balance.
Cancel any time in the web studio under Account → Manage subscription. Your plan stays active to the end of the period you paid for and is not renewed after it. Cancelling does not refund the current period.
Changing plans takes effect at your next renewal, and you are then charged the new plan’s price. Switching to a plan with a longer period, such as from weekly to monthly, starts the new plan straight away and charges its full price.
If a renewal payment fails, it is retried for a short time. If it still fails, the subscription ends.
If we change a plan’s price, we will tell you before the new price applies to your renewals, and you can cancel before then.
4. Payments
Prices are shown in US dollars on the pricing page and at checkout. Taxes may be added where they apply.
Payments are processed by Stripe. Credits from a credit pack are added as soon as the payment is complete.
5. Refunds
Credits are delivered right away, and images are digital content. By buying, you ask us to deliver them immediately, so credits you have already used are not refundable, except where the law requires otherwise.
If a purchase was not credited, or credits were used because of a technical problem on our side, contact us and we will put it right.
If a payment is refunded or reversed, including through a chargeback, the credits from that payment are removed from your balance.
We may refuse refunds in cases of abuse or fraud.
6. Acceptable use
You may not use the web studio to create, upload or share:
Sexual content involving minors, or any content that sexualises or exploits children.
Sexual or intimate images of a real person without their consent.
Images of real people meant to deceive, harass, threaten or defame them.
Content that infringes someone else’s rights, or that is unlawful where you live.
You also may not try to get around credit costs or usage limits, interfere with the service, or access it by automated means other than the studio. We may block prompts or images that break these rules, and suspend accounts that do.
7. Your content
You keep your rights in the photos and prompts you add. You must have the right to use them, including permission from the people shown in your photos.
You let us store and process them, and the images generated for you, only to provide the web studio, as described in our privacy policy.
As far as the law allows, you may use the images generated for you for any lawful purpose, including commercial use. AI can produce results that are inaccurate, or similar to images made for others, so check a result before you rely on it.
8. The service
We may add, change or remove models, templates and features. The credit cost of a model can change; the studio always shows the current cost before you generate.
We try to keep the web studio available, but it may sometimes be interrupted for maintenance or because of a provider.
You can stop using the web studio and ask us to delete your account at any time. We may suspend or close an account that breaks these terms; any credits left in it are then lost.
9. Disclaimer and liability
The web studio is provided “as is”, without warranties of any kind, to the fullest extent the law allows. We are not liable for indirect, incidental or consequential losses. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these terms limits rights you have under consumer law that cannot be limited.
10. Changes and governing law
We may update these terms. We will post the new version here and change the date at the top; for important changes, we will tell you in the web studio before they take effect. These terms are governed by the laws of the United States.
